1. Who we are

ORBITH Edit is a video generation and editing service, built first for real-estate listing videos, operated as a sole-operator business ("ORBITH Edit," "we," "us," or "our") based in Waco, Texas, USA. Our website is https://edit.orbith.tech.

This policy explains what personal data we collect when you use ORBITH Edit, why we collect it, who we share it with, how long we keep it, and the rights you have. It applies to the website, the video-generation service, and any related email we send you.

Our service is built for businesses and professionals acting in a business capacity, first among them real-estate agents and brokers. It is not intended for consumers buying for personal, family, or household purposes, and it is not directed to anyone under 18.

We do not intentionally collect sensitive personal data (for example, government ID numbers, precise geolocation beyond IP-level, health data, or biometric identifiers). Please do not upload footage or enter details containing other people's sensitive personal data without their permission.

We do not use your data to build advertising profiles, we do not sell it, and we do not use it to train third-party AI models beyond the per-request processing needed to generate your video (see Section 7 regarding Anthropic).

5. Listing scraping and the content in your videos

When you paste a listing URL, our service automatically retrieves the publicly available photos and property details from that listing so it can assemble your video. We act on your instruction; you choose which listings to submit.

You are responsible for ensuring you have the necessary rights and permissions to use each listing's photos, descriptions, and any other content in a marketing video, and for complying with the terms of the source website (for example Zillow, Redfin, or a broker site) and any applicable MLS or brokerage rules. If a listing contains personal data about other people (for example a current occupant), you are responsible for handling it appropriately. We do not control those third-party websites and are not responsible for their content or privacy practices.

6. Legal bases and why our use is lawful

ORBITH Edit operates from Texas and serves US-based business users. US state privacy laws such as the Texas Data Privacy and Security Act do not use the "legal basis" framework found in the EU GDPR. We nevertheless want to be transparent about why each use is justified:

Our hosting infrastructure runs on Amazon Web Services in the United States (Section 10).

We will keep this list current. If we add or change a sub-processor in a way that materially affects your data, we will update this policy.

8. How we share data (and how we do not)

We do not sell your personal data. Under the Texas Data Privacy and Security Act, a "sale" means sharing personal data with a third party for monetary or other valuable consideration. Our sharing with the providers in Section 7 is disclosure to processors and to third parties for the sole purpose of providing the service you requested, which the Act specifically excludes from the definition of "sale." We also do not use your personal data for targeted advertising or for profiling that produces legal or similarly significant effects about you.

9. Cookies and similar technologies

We keep cookie use to a minimum. We do not use advertising or cross-site tracking cookies.

These cookies are strictly necessary to operate the service, so the service may not function if they are blocked.

Do Not Track. There is no common industry standard for how to interpret DNT, and because we do not engage in cross-site tracking or targeted advertising, we do not currently respond differently to DNT signals. We will update this section if that changes.

Third-party tracking. We do not knowingly allow third parties to collect personally identifiable information about your activity across other websites through our service.

10. Where your data is stored and how we protect it

Your account data, uploaded footage, and generated videos are stored on Amazon Web Services (AWS) infrastructure in the United States (us-east-1), on servers we configure and operate; videos shared through listing links are delivered from AWS S3 and CloudFront, and encrypted database backups are kept on S3 with automatic expiry. Payment data is held by Stripe; email delivery data by Resend; network and security data by Cloudflare.

We use reasonable administrative, technical, and physical safeguards appropriate to a small operator, including:

No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we ever experience a data breach affecting your personal data, we will notify you and the appropriate authorities as required by applicable law, including the Texas breach-notification statute.

11. Retention: how long we keep your data

Finished videos and versions Kept in your gallery so you can re-download them, until you ask us to delete them or you close your account. Older video data may be moved to archival cloud storage without affecting your access.
Abandoned or unpaid working files (uploads, drafts, scraped inputs for a project that was never paid for or completed) Automatically deleted after about 7 days.
Technical logs (including IP) Kept only as long as needed for security, rate-limiting, and abuse prevention; application logs are size-capped, rotate automatically, and are routinely cleared by service updates. Edge and security logs are handled by Cloudflare and AWS under their policies.

When you ask us to delete your data, or when a retention period ends, we delete or de-identify it, except where we are legally required to keep it (for example, completed-transaction tax records).

12. Your privacy rights

If you are a Texas resident, the Texas Data Privacy and Security Act gives you the right to confirm/access, correct, delete, obtain a portable copy, and opt out of the sale of personal data, targeted advertising, and certain profiling (we do none of these, so there is nothing to opt out of, but you may still submit a request), plus the right to appeal a denial.

A note on the Texas small-business status. ORBITH Edit is operated by a sole operator and qualifies as a "small business" under the SBA size standards the Act uses to define its scope. Under the Act, small businesses are exempt from most obligations and only must obtain consent before selling sensitive personal data. We do not sell any personal data, sensitive or otherwise. Even though much of the Act does not strictly bind us, we choose to honor the consumer rights above.

If you are a California resident, you may have similar rights (know, delete, correct, opt out of sale/sharing) and the right not to be discriminated against for exercising them. We do not sell or share your data for cross-context behavioral advertising.

How to exercise your rights. Email us at edit@orbith.tech (subject "Privacy Request") from your account email. We will verify your identity (typically by confirming control of your account email) and respond within 45 days (extendable by 45 more, with notice). Free up to twice per year; we may charge a reasonable fee for excessive or repetitive requests.

Appeals. If we decline, you may appeal by emailing edit@orbith.tech (subject "Privacy Appeal"); we respond within 60 days. Texas residents may then contact the Texas Attorney General: https://www.texasattorneygeneral.gov/consumer-protection/file-consumer-complaint/consumer-privacy-rights.

Authorized agents. You may use an authorized agent; we may ask for proof of authorization and may still verify your identity directly.

13. Email communications

Most email we send is transactional: sign-in magic links, payment receipts, video-status updates, and delivery notices. These are part of providing the service you requested, and you cannot opt out of them while you have an active account.

If we ever send marketing email, we will comply with the US CAN-SPAM Act: identify it as a promotion, include a valid physical postal address, and give you a working unsubscribe that we honor promptly. We will only send marketing email if you opt in.

14. Children's privacy

ORBITH Edit is a business tool for real-estate professionals and is not directed to children. We do not knowingly collect personal data from anyone under 18. You must be at least 18 to use the service. If you believe a minor has provided us personal data, contact us at edit@orbith.tech and we will delete it.

15. Third-party links and content

Our service interacts with third-party websites (for example the listing sites you submit) and includes links to providers' policies. We are not responsible for the privacy practices or content of those third parties.

16. Changes to this policy

We may update this policy as our service, our providers, or the law changes. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you by email or a site notice. Continued use after an update means you accept the revised policy.
